Notification of the Committee on Labeling: Determination of car seat as label-controlled goods

At present, car seat is used to protect children from accidents, reduce severe injuries, and prevent children from death. For consumers to receive the completed information before deciding on purchasing and be protected to receive the safety of goods; therefore, the car seat will be determined as label-controlled goods.

By Section 30 and Section 31 of the Consumer Protection Act, B.E. 2522 (1979), as amended by the Consumer Protection Act (No. 2) B.E. 2541 (1998), the Committee on Labels hereby issues the Notification as follows:

Article 1. In this Notification

“Car seat” means the safety seat or special seat for children to prevent the hazard. Such car seats shall have the equipment attached to children's bodies and support children for sitting or supine. The components of the car seat shall include harness webbing or flexible components, crotch buckle, harness adjuster tools, attached devices, and other support tools such as baby mattresses, baby carriers, booster seats, or car seat cushions attached with seat for the proper position in the car.

Article 2. Car seats shall be label-controlled goods.

Article 3. The label of label-controlled goods according to Article 2 shall specify the statement, figure, artificial mark, or image as appropriate, depending on the case. But such a statement must be true, does not cause misunderstanding about the essence
of the goods, and must be in the Thai language or a foreign language accompanied by
the Thai language to explain the meaning of the figure, artificial mark, or image that can be visible and legible. In this regard, it must be by

Article 4. The first paragraph does not apply to the labels of label-controlled goods manufactured for export and not for sale in Thailand.

(1) Name of the category or type of goods that can be understood as the goods;

(2) Name or trademark registered in Thailand of the producer for sale;

(3) Name or trademark registered in Thailand of a person ordering or importing the goods into the Kingdom for sale;

(4) In case of the goods imported for sale, the name of the producing country shall be specified;

(5) The location of the producer for sale or a person ordering or importing the goods into the Kingdom for sale;

(6) For size, dimension, quantity, volume, or weight of the goods as the case may be, the applied unit could be used as the full name or abbreviation or symbol such as width X length X height in centimeters.

(7) The usage method shall be indicated to inform consumers to understand what is the objective of the goods such as being the safety seat for children to prevent the hazard, and being a seat for children while they are sitting in a car.

(8) Instruction of usage and prohibition for the accuracy that will be the benefit for consumers shall be displayed on the product with at least the following details;

1. The car seat is suitable for children of .... years old.
2. The car seat is suitable for a child who has weight is ... kilograms or height is... centimeters.
3. To inspect the safety car seat regularly.
4. Not allow a child to sit in a car seat in a car alone.

(9) Warning shall be displayed as the following messages;

1. Not allow installing a rear-facing car seat on the front seat in a car that installs an airbag to prevent any serious injuries or death in children when the airbag works. Furthermore, the warning should show a rectangle symbol with a width of 3 inches and a length of 4 inches, and the warning message must use bold letters that are bigger than other letters in a rectangle frame. The color frame and text must contrast with the background color of the label which is shown in a durable characteristic of a product.
2. The car seat, which is manufactured to attach with a cushion for safety, must be indicated the warning “If the car seat is not attached with a cushion correctly, it may be a danger to life”. The letters of such warning must be contrasted with the background color and the letter size is not less than 5 millimeters.

(10) The documents or installation manual must be specified at least the following details;

1. Components, structures, parts, or materials are made of a car seat.
2. Installation steps, usage methods, and maintenance methods.
3. Installation equipment for a car seat such as a Safety Belt or ISOFIX systems.
4. Recommendations for the safety of using a car seat.
5. Warranty period ... years and warranty conditions.

(11) The date, month, and year of production. Unless the date of production cannot be specified. In such cases, only the week and year of production or the month and year of production may be specified so that the consumers can understand the benefit of the quality or characteristics of such goods.

(12) The date, month, or year of the expiration or the date, month, or year which shall be used before the specified date, month, or year shall be applied for limited-time goods only so that the consumers can understand the benefit of quality or characteristics of such goods.

(13) The price shall be specified in Thai baht or other currencies.
